Membership Agreement
By purchasing a Fit Bomb membership, class pack, personal training session, or other service, you agree to the following Terms & Conditions.
Membership Payment Terms

All memberships are billed monthly via direct debit.
-
A valid debit or credit card must be entered and securely saved at the time of sign-up.
-
By signing up, you authorise Fit Bomb to process recurring monthly membership payments using your nominated payment method.
-
It is the member’s responsibility to ensure payment details remain current and valid.
-
Failed or declined payments may incur additional processing fees and may result in suspension of membership access until outstanding amounts are paid.
Membership Pauses
We understand that life happens and flexibility matters.
Members may place their membership on hold under the following conditions:
-
A minimum of 7 days’ written notice is required prior to the requested pause date.
-
Memberships may be paused:
-
for a maximum total of 8 weeks per calendar year; AND
-
a maximum of 3 separate pause requests per calendar year.
-

Pause requests must include both a start and end date, and be in 7 day blocks
-
Open-ended or indefinite pauses are not permitted.
-
Any outstanding fees or failed payments must be resolved prior to pause being activated.
-
Membership payments will automatically resume at the conclusion of the nominated pause period.
-
Unused pause allowances do not roll over into future years.
Fit Bomb reserves the right to request supporting documentation for extended medical pauses where appropriate.
Membership Cancellations

Membership cancellations require a minimum of 14 days’ written notice submitted via email.
-
Memberships remain active, including scheduled payments, during the notice period.
-
Verbal, sms or social media cancellation requests will not be accepted.
-
Any outstanding fees or failed payments must be resolved prior to cancellation being finalised.
-
Memberships cannot be backdated or cancelled retrospectively.

Class Cancellation Policy
To ensure fairness to all members and coaches:
-
Cancellations for class bookings must be at least 2 hours prior to the scheduled class start time.
-
Cancellations made within 2 hours of the class start time, or failure to attend
(“no show”), will incur the full class/session fee.

Cancellations made within 2 hours of the class start time, or failure to attend
(“no show”), will incur the full class/session fee.
-
Cancellations made within 2 hours of the class start time, or failure to attend
(“no show”) by Unlimited Members, on a Waitlisted Class (depriving another member of a spot) will incur a $10 penalty fee, which will be donated to The Cat Haven.
Personal Training Payment Terms

Personal Training Cancellation Policy

Personal training appointments must be cancelled or rescheduled at least 24 hours in advance.

PT sessions cancelled within 24 hours of the appointment will incur a 50% cancellation fee.

PT sessions cancelled within 1 hours of the appointment, or failure to attend
(“no show”), will result in the full session fee being charged.

Physiotherapy and Clinical Pilates Cancellation Policy

Physiotherappy and Clinical Pilates appointments must be cancelled or rescheduled at least 24 hours in advance.

Appointmenst cancelled within 24 hours of the appointment will incur a 50% cancellation fee.

Appointments sessions cancelled within 1 hour of the appointment, or failure to attend
(“no show”), will result in the full session fee being charged.
Cancellations via Social Media are invalid
Photography, Filming & Social Media
Fit Bomb is an active and community-focused space, and photography and video content may be captured within the gym from time to time for use on Fit Bomb’s social media, website and other promotional material.
We completely respect that not everyone wants to appear in our content. If you do not wish to be photographed or filmed, or do not want content featuring you to be published, please let a Fit Bomb team member know or email hello@fitbomb.com.au to opt out.
We will take reasonable steps to ensure you are not intentionally included in identifiable promotional content.
Where a client is the specific or primary subject of promotional content, such as a testimonial, progress story, interview, featured photograph or physiotherapy-related content, we will seek appropriate consent before publishing it.
Fit Bomb will not intentionally disclose a client's private information through photographs, videos or social media content without appropriate consent.
Clients are also asked to be considerate when taking their own photographs or videos within the gym and to respect the privacy of other clients, staff and physiotherapy patients.
If you have previously appeared in Fit Bomb content and have concerns about its continued use, please contact the Fit Bomb team.
Operations Policy
Every possible effort will be made to deliver classes and services on time as advertised. However the schedule is subject to change or cancellation without notice. We promise to make every effort to ensure this doesn’t happen! If it does, we will refund or transfer credit for classes /sessions that are changed or cancelled for any reason by us.
If you have not booked into a class, but show up in the hope of joining, you will be welcomed if there is space. However there is no guarantee. If the class has reached capacity, you will not be permitted to join.
Health & Safety
By participating in classes, PT, clinical Pilates, or other services, members acknowledge that:

Exercise carries inherent risks.

Members participate voluntarily and at their own risk.

Members must advise their coach of any injuries, medical conditions, pregnancies, or concerns that may affect participation.

Fit Bomb reserves the right to refuse participation where safety may be compromised.
Rules of Conduct
Community spirit, respect, and having fun, are at the heart of our ethos at Fit Bomb. Aggressive, abusive, or bullying behaviour will not be tolerated under any circumstances. We reserve the right to refuse entry at any time and cancel memberships without refund in this instance.
Client Property
We are not responsible for the safekeeping of your belongings. We advise that you should store any belongings in the shelves provided within the studio, at your own risk. Please don’t bring valuables to class.
Changes to Timetable or Services
Fit Bomb reserves the right to:

amend class timetables,
-
change instructors,
-
adjust opening hours,
-
substitute services,
-
or modify membership structures where reasonably necessary.
Refund Policy
Memberships, packs, and sessions are generally non-refundable except where required under Australian Consumer Law.

Teen Classes
Teen classes are purchased as a term-based pack, with your child’s place reserved for the duration of the term. If your child is unable to attend a scheduled class for any reason, including illness, holidays or other commitments, the missed session is non-refundable and cannot be redeemed as a credit or transferred to another term. Where possible, Fit Bomb will endeavour to offer a make-up session during the school holiday period for missed classes; however, make-up sessions are subject to scheduling, staffing and availability and cannot be guaranteed. Any make-up sessions offered are at Fit Bomb’s discretion and have no cash or credit value.
Kids:
We are a family friendly gym, however we don't have a creche or any childcare. Children 14+ are welcome to sign up and attend classes and PT. Children 6+ are welcome to sign up and join our Kids classes. Children under 14 may be permitted to join classes and PT at the coach or management's discretion.
Children not booked in are welcome on the premises at your own risk and are your responsibility. Children must be off the gym floor (in reception) while classes are in progress, and are not permitted to touch or play with gym equipment or behave in a way that is distracting to other gym users or coaches. If you or your kids are unable to adhere to this, they won't be allowed in future. This is for everyone's safety. If your kids make a mess or drop crumbs you must clean this up before you leave (you may use our vacuum and cleaning products - ask a staff member)
Pets:
We are a pet friendly gym, pets are welcome on the premises at your own risk. They must be kept on leash at all times and are your responsibility. Pets must be off the gym floor while classes are in progress. If they behave in a way that is distracting to other gym users or coaches they won't be allowed in future. This is for everyone's safety. If your pet makes a mess or sheds hair you must clean this up before you leave (you may use our vacuum and cleaning products - ask a staff member).
Preparation for Exercise
Fit Bomb recommends you stay well rested, well hydrated and well fuelled before and after exercise. This is your responsibility. Failure to do so may result in fatigue, discomfort, dizziness, fainting, nausea and increased muscle soreness.
Fit Bomb recommends wearing comfortable activewear and training shoes to exercise. Any pain, injury or discomfort caused by inappropriate attire or footwear is your responsibility.
Complaints
Any enquiries or complaints be submitted in writing in the first instance. Where an in-person discussion is needed, we'll arrange a meeting during office hours with the appropriate manager present, so the conversation can be handled properly and everyone comes prepared.

Club Fit Bomb Pty Ltd (Fit Bomb) is committed to protecting the privacy of individuals whose personal information we collect and hold.

5. Photography and video
Photography and video recording may occur at Fit Bomb premises and at Fit Bomb events, classes, activities, competitions and promotional activities.
Photography and video may be used for purposes including:

advertising Fit Bomb's services;

creating social-media content;

celebrating member achievements;

5.1 Incidental photography
Fit Bomb may occasionally capture people, vehicles, property or other identifying features incidentally in photographs or videos. Where an individual or item is incidental to the intended subject of the photograph, Fit Bomb may use the image where doing so is permitted by law.
Fit Bomb will take reasonable steps to avoid unnecessarily publishing identifiable personal information that is unrelated to the purpose of the content.
Where reasonably practicable, Fit Bomb may crop, obscure or blur incidental identifying information, including faces, vehicle registration plates, names, documents or screens.
5.2 Deliberate promotional photography
Where Fit Bomb deliberately photographs or records an identifiable individual for marketing, advertising or promotional purposes, Fit Bomb will seek appropriate consent where required by law.
Where consent is obtained, the consent may cover publication through multiple Fit Bomb marketing channels, including:

5.3 Health-related images

Where an image constitutes personal information and involves health information or other sensitive information, Fit Bomb will only collect, use or disclose the image where permitted by the Privacy Act and, where required, with appropriate consent.
Fit Bomb will take particular care when creating or publishing content involving physiotherapy, clinical pilates, rehabilitation or other health services.
5.4 Consent to promotional content
Where appropriate, Fit Bomb may ask individuals to provide specific consent for photographs, video or other content to be used for promotional purposes.
Consent may be provided electronically, in writing or by another appropriate method.
Individuals may withdraw consent for future use of promotional content by contacting Fit Bomb.
Withdrawal of consent will not necessarily require Fit Bomb to remove content that:

These platforms may include Instagram, Facebook, TikTok, YouTube and other platforms that Fit Bomb may use from time to time.
Information published on social-media platforms may be viewed, copied, downloaded, shared, reposted or otherwise used by third parties.
Once content has been published on a third-party platform, Fit Bomb may have limited ability to control subsequent use of that content.
Each social-media platform also operates under its own privacy policy and terms of service.
Fit Bomb will take reasonable steps to comply with its obligations under the Privacy Act when using these platforms.
7. Direct marketing
Fit Bomb may use personal information to communicate with individuals about Fit Bomb's services, programs, events, promotions and other offerings where permitted by law.
Where consent is required for direct marketing involving sensitive information, Fit Bomb will obtain the required consent.
Individuals may opt out of direct marketing communications at any time by:

Where an eligible data breach occurs and the Notifiable Data Breaches scheme applies, Fit Bomb will comply with its notification obligations under the Privacy Act.

Fit Bomb will respond to access requests in accordance with the Privacy Act.
In some circumstances, Fit Bomb may be permitted or required to refuse access or provide only limited access. Where permitted, we will explain the reason for any refusal or limitation.

You may ask Fit Bomb to correct personal information we hold about you if you believe it is inaccurate, incomplete, out of date or misleading.
Fit Bomb will take reasonable steps to correct information where appropriate and in accordance with the Privacy Act.

If you believe Fit Bomb has mishandled your personal information, you may make a privacy complaint using the contact details below.
We will investigate and respond to complaints in accordance with our privacy procedures.
We encourage you to contact us first so that we have an opportunity to investigate and resolve your concern.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC).
17. Anonymity and pseudonymity
Where lawful and practicable, you may interact with Fit Bomb anonymously or using a pseudonym.
However, this may not be possible where we need to identify you to provide a service, manage a membership, process a payment, comply with a legal obligation, maintain health records or otherwise conduct our business.
